BANGKOK – A Thai court found three top officials in the government of former Prime Minister Thaksin Shinawatra guilty Wednesday of illegally establishing and managing a state lottery. They were given suspended jail terms and fined.
The ruling by a branch of the Supreme Court that handles cases of political officeholders amounts to the latest salvo in a three-year political battle between supporters and opponents of Thaksin, who was ousted by a September 2006 military coup after being accused of corruption and abuse of power.
Thaksin was one of 47 defendants, but judgment against him was suspended because he is a fugitive in another case.
The lottery was suspended after the coup, though successive governments have discussed relaunching it.
The original complaint in the lottery case was brought by the Assets Examination Committee, which was established by the coupmakers to probe wrongdoing in Thaksin''s 2001-06 administration. The attorney general''s office rejected the case, so the committee submitted it directly to the court.
The committee and other state bodies have launched numerous probes against Thaksin, but he has so far been convicted on a fairly minor conflict of interest charge. Thaksin went into self-imposed exile before of the ruling.
The court Wednesday gave suspended two-year jail terms to former Deputy Finance Minister Varathep Rattanakorn, former Permanent Secretary for Finance Somchainuek Engtrakul, and former Government Lottery Organization director police Maj.-Gen. Surasit Sangkhapong. They were also fined 10,000-20,000 baht ($298-596) each.
The court ruled the men had acted illegally in establishing a two- and three-digit lottery scheme in 2003 and then misallocated the proceeds.
Forty-three other defendants were acquitted. The defendants included 29 members of Thaksin''s Cabinet.
The original complaint alleged that irregularities in the scheme caused the state 36.9 billion baht ($1.17 billion) in financial losses.
Thaksin''s government launched the lottery in 2003, saying it would lure people away from the popular illegal underground lottery and would generate revenue for education.
The forces that helped unseat Thaksin _ the military, Bangkok''s educated middle class, and the country''s elite, including elements associated with the country''s monarchy _ have worked hard to erase Thaksin''s political legacy. They changed the constitution to limit the power of big parties and sought to demonize him as a corrupt destroyer of democracy.
His supporters say it is the elite who are rolling back democracy, because Thaksin''s party twice won easy general election victories.
The political battle has resulted in sustained street protests and violence by both sides, with no end to the instability in sight.
On Tuesday, the National Anti-Corruption Commission said former Prime Minister Samak Sundaravej and former foreign minister Noppadon Pattama should be prosecuted for dereliction of duty and negligence.
The commission''s finding was seen by some as reflecting political bias, because it fit a pattern of rulings against Thaksin''s supporters. Samak became prime minister after a pro-Thaksin political party won a December 2007 general election. He was unseated by a court ruling that he violated a conflict of interest statute by accepting payment for hosting a television cooking show.

ส่วนคณะรัฐมนตรีในสมัยรัฐบาลพ.ต.ท.ทักษิณ ชินวัตร อาทิ พล.อ.ชวลิต ยงใจยุทธ อดีตรองนายกรัฐมนตรี,นายสมคิด จาตุศรีพิทักษ์ อดีตรองนายกรัฐมนตรี,นายเนวิน ชิดชอบ อดีต รมช.เกษตรและสหกรณ์ ,นายสรอรรถ กลิ่นประทุม อดีต รมว.เกษตรฯ ศาลมีคำตัดสินให้ยกฟ้อง เนื่องจากไม่มีเวลาพิจารณาโดยถ่องแท้ และไม่มีเจตนาทุจริต
โดยในส่วนของนายวราเทพ นายสมใจนึก และ พล.ต.ต.สุรสิทธิ์ ถือว่าผิดกฎหมายอาญา มาตรา 157 ปฏิบัติหน้าที่โดยมิชอบ ละเว้นการปฏิบัติหน้าที่โดยมิชอบ และกระทำการฝ่าฝืนว่าด้วย พ.ร.บ.ของรัฐ แต่ไม่ได้มีเจตนาในการยักยอกทรัพย์ จึงมีมติเป็นเอกฉันท์ว่าไม่จำเป็นต้องคืนเงินจำนวน 14,000 กว่าล้านบาท ให้รัฐ ตามคำร้องของ คตส
